2. General information about data processing

This website provides information about the PC game EVILGARD and the independent project behind it, EVILGARD Interactive.

Personal data are processed only where this is necessary for the technical provision and security of the website, for handling enquiries or to meet legal obligations.

In its current technical state, the website does not use its own analytics, advertising or tracking services.

3. Hosting by STRATO

This website is hosted by:

STRATO GmbH
Otto-Ostrowski-Straße 7
10249 Berlin
Germany

When you access the website, the web server processes data that are technically necessary. This may include:

This processing is carried out to provide the website technically, ensure the stability and security of the service, and detect and defend against attacks or misuse.

The legal basis is Article 6(1)(f) GDPR. The legitimate interest is the secure, stable and functional provision of this website.

STRATO states that it stores visitors’ IP addresses for a maximum of seven days to detect and defend against attacks. According to STRATO, host names and IP addresses are anonymised in web-server log files made available to hosting customers; these log files may be available in the customer area for a limited period.

Where STRATO processes personal data on behalf of the website operator, this takes place under a data processing agreement pursuant to Article 28 GDPR.

4. Cookies and similar technologies

In its current technical state, this website does not set cookies for analytics, advertising or profiling, and does not use cookies or local-storage entries for language switching. Language selection is made through the German and English URLs.

Where the hosting provider uses session cookies or comparable technical mechanisms that are strictly necessary for technical delivery, they serve solely to provide and operate the digital service explicitly requested.

Where the storage of information on a device or access to information already stored there is strictly necessary, its permissibility is governed by section 25(2) of the German Telecommunications Digital Services Data Protection Act (TDDDG). For associated processing of personal data, Article 6(1)(f) GDPR applies where relevant.

No non-essential tracking or marketing cookies are currently used. Therefore, based on the present technical configuration, no consent banner is provided for analytics or marketing purposes.

5. Contact by email

When you contact us by email, the personal data you provide are processed, in particular your email address, the content of your message and any further information you choose to provide.

The processing is carried out to handle and respond to your enquiry.

Where an enquiry relates to entering into or performing a contract, the legal basis is Article 6(1)(b) GDPR. In all other cases, the processing is based on Article 6(1)(f) GDPR. The legitimate interest is handling and responding to enquiries about EVILGARD and EVILGARD Interactive.

The data are erased once the enquiry has been conclusively dealt with, unless statutory retention obligations or other legitimate grounds require further storage.

6. Language selection

The website is offered in German and English. The selection is made through separate language versions and URLs.

In its current technical state, language selection does not create personal user profiles and does not use tracking cookies.

8. No web analytics or profiling

In its current technical state, this website does not use services such as Google Analytics, Google Ads, Meta Pixel or comparable analytics and advertising services.

The operator does not track usage behaviour personally or create user profiles for advertising purposes.

9. Recipients of personal data

Personal data are passed on only where this is necessary to operate the website, a legal obligation exists or another legal basis permits it.

In the context of hosting, STRATO GmbH may in particular be a recipient of technically necessary data as a processor.

10. Retention period

Personal data are stored only as long as necessary for the respective processing purpose.

Where statutory retention obligations apply, data are stored for the duration of those obligations. The retention periods described under “Hosting by STRATO”, or the periods actually provided by the hosting provider, apply to server and security logs.

11. Your rights

Subject to the applicable legal conditions, you have the following rights in particular:

Where processing is based on your consent, you may withdraw that consent at any time with effect for the future. This does not affect the lawfulness of processing carried out before withdrawal.

To exercise your rights, contact contact@evilgard.com.

12. Right to lodge a complaint with a data protection authority

Under Article 77 GDPR, you have the right to lodge a complaint with a data protection supervisory authority.

For the controller’s location, the relevant authority is in particular:

The Commissioner for Data Protection and Freedom of Information of Rhineland-Palatinate
Hintere Bleiche 34
55116 Mainz
Germany

Email: poststelle@datenschutz.rlp.de

13. Automated decision-making

No decision based solely on automated processing, including profiling within the meaning of Article 22 GDPR, takes place in connection with this website.

14. Changes to this Privacy Policy

This Privacy Policy will be updated if the website, its technical services or legal requirements change.

Before adding further services – for example external video players, web analytics, advertising tracking, newsletter systems, contact forms or social-media widgets – it must be assessed whether this Privacy Policy needs to be updated and whether a consent solution is required.

Right to object

Where processing is based on Article 6(1)(f) GDPR, you may object on grounds relating to your particular situation. To do so, contact contact@evilgard.com. Processing will then not continue unless there are compelling legitimate grounds or it is needed to establish, exercise or defend legal claims.
